Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Kindred Web Studio ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and clients who access or use our website design, development, and related services.

2. Services

Kindred Web Studio provides website design, development, conversion rate optimization, and related digital services for businesses. The specific scope of services will be outlined in individual project proposals or agreements.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Project Terms & Payment

All projects require a signed proposal or contract before work begins. Payment terms are as follows unless otherwise specified in writing:

• 50% deposit required before project commencement
• Remaining 50% due before final delivery/launch
• All payments are non-refundable once work has begun
• Late payments may result in project delays or suspension

Custom payment arrangements for larger projects may be negotiated and will be documented in the project agreement.

4. Intellectual Property

Upon full payment, clients receive ownership of the final deliverables created specifically for their project, including custom designs and code.

We retain the right to:

• Display completed work in our portfolio
• Use project screenshots for marketing purposes
• Retain ownership of pre-existing tools, frameworks, and methodologies

Third-party assets (fonts, images, plugins) remain subject to their respective licenses.

5. Client Responsibilities

Clients are responsible for:

• Providing accurate and timely content, feedback, and approvals
• Ensuring they have rights to all materials provided to us
• Maintaining backups of their existing website before we begin work
• Communicating project requirements clearly and promptly
• Reviewing and approving deliverables within agreed timeframes

6. Revisions & Changes

Each project includes a specified number of revision rounds as outlined in the project proposal. Additional revisions or scope changes may incur extra charges.

Significant changes to project scope after work has begun will require a change order with updated timeline and pricing.

7. Limitation of Liability

To the maximum extent permitted by law, Kindred Web Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific project in question.

8. Warranties & Disclaimers

We provide a 30-day bug fix warranty after project launch for any technical issues directly caused by our work. This does not cover issues arising from client modifications, third-party services, or hosting environments.

We do not guarantee specific results such as traffic increases, conversion rates, or search rankings, as these depend on many factors beyond our control.

9. Termination

Either party may terminate a project with written notice. Upon termination:

• Client is responsible for payment of all work completed to date
• We will provide all completed work and assets upon receipt of payment
• Deposits are non-refundable

10. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation, and if necessary, binding arbitration.

11. Changes to Terms

We reserve the right to update these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the updated terms.
